Planning to start an NGO? Need income Tax exemption and benefits of 80G?

The most important thing to of an NGO is not to shell out money in paying tax rather to use it for NGO's object. Hence, it becomes necessary to register your NGO under 12AB. Also, to give the doners the benefit it is necessary to register your NGO under 12AB.



When the Trust deed is registered, we need to apply for Trust PAN having T as 4th letter of PAN.


Once PAN is received, we need to get the documents ready (as mentioned at the end) and apply provisional registration (Form 10A, done online). Once the provisional registration is received (automatic process), we have to apply for final registration (Form 10AB, done online) within 6m from commencement of activities or 6m before the end of 3year from when the registration is given.


The final approval is received after having personal hearing from the concerned AO.


Post this FCRA Registration can be applied. (FCRA has its own specific conditions to be fulfilled)

Documents:

  • Registration Certificate Memorandum of Association (MOA) or Trust Deed –two copies which are to be self-attested by the head of NGO.

  • NOC or No Objection Certificate received from landlord where the registered office is situated.

  • Copy of registration with Registrar of Companies or Registrar of Firms and Societies OR Registrar of Public Trusts- Self Attested Copy.

  • The Self Certified Copy of documents evidencing adoption and modification of the objects.

  • A copy of PAN Card of NGO or Trust or an Institution.

  • Photo Copy of the Electricity Bill or House Tax Receipt Bill or Water Bill.

  • A proof of the welfare activities pursued.

  • The list of the contributors and the donors along with their address and PAN.

  • A self-certified copy of registration granted or registration denied under section 12AB if any.

  • The description of the overall business carrying out by the institution or trust.

  • A progress Report of previous three years since the formation of the NGO.
